    Frontier 2nd Step Grievance Meetings:

    March 27th, 2018 Grievance Committee in attendance: John Pusloskie, Andy Cimino, Sue Phillips, Rich Winter, Steve Spector and Mike Sutphen.

    Grievance 2-2584-18 disparity of treatment emergency time off, Sam Watkins was denied an emergency vacation day on January 24th, 2018.  On April 2nd the Company replied denying the grievance, stating there was not a violation of the contract.

    Grievance 2-2585-18- The Union grieved that Ernie Magar was unfairly laid off per the CBA.  The Company position was Ernie couldn’t perform the job without any assistance therefore failing to demonstrate satisfactory performance.

    Grievance 5-326-18 – The Company is violating the contract by not dispatching on all new HIS orders.  The Company has put the mechanisms in place to ensure that all orders are dispatched on.

    Grievance 2-2589-18 The Union grieved the written warning issued to James Wojtarowicz.  The Company position was they weren’t moving off the warning.  They had agreed not to address other issues if there were no future instances and they can’t overlook this one.

    Grievance 2-2589-18- The Union grieved that Connecticut supervisors were performing bargaining unit work of Desk Techs.  Marian Wyand stated that they’ve addressed the issue with Management and management will cease and desist from performing bargaining unit work.

    Grievance 3-4162-18 – Beginning on March 5th management and contractors were taking status calls and entering new tickets, this is bargaining unit work.  Management agreed that they had changed the titles of some employees to perform hourly work and they have contractors who enter tickets for small business.  The Union has requested a cease and desist and everyone be offered an overtime make up.  To date we haven’t received an answer.

    Closed Out:

    Grievance 7-1480-18 Tony NaDell was unfairly denied a payout on Lead #1408224 for Monroe County 911.  The Company agreed to adjust the Grievance and pay Tony $50.00 for the access line lead.

    Arbitration Update Frontier:

    • Transfer of bargaining unit work due to M6 Conversion.

    The arbitrator has offered September 21st to hear the case.

    • The National Labor Relations board has issued a complaint in regards to the Unfair Labor charge failure to provide information M6. The Company provided the final information as of March 21st.  The charge has been settled and the Union is moving forward with the arbitration
    • Grievance 7-1476-17 Unjust termination James Everts request arbitration 2/2/18.
      • The arbitration has been approved by our CWA Staff Rep, it now is pending review with the District 1 office.
    • Grievance 7-1477-17 Unjust termination Peter Loss request arbitration 2/2/18.
      • The arbitration has been approved by our CWA Staff Rep, it is now pending review with the District 1 office.
    • Grievance 7-1479-18 Unilateral change to Long term disability income capping it at $3,000 per month. The grievance was protected for arbitration on May 15, 2018.

    Managerial Changes

    Julie Murtagh has been announced as the new Sr. VP of Operations for the East Region.

    Lyle Fell CNOC manager resigned effective April 30th.

    Frontier Updates:

    • The Company has started safety inspections out in the field as well as focusing on referrals and the reasons for them. We urge all members to follow safety policies.
    • May1st the Company reported 1st quarter 2018 results, revenues fell by 157 million dollars from the same period in 2017. This was viewed as progress by shareholders.
    • May 9th was the Company’s annual shareholders meeting. A recording of it can be found on the shareholders services website.
    • The Company has polled all clerical to be a Communications Coordinator III, engineering to replace the retirement of Mavis Lockett.
    • The Union has requested an update on the work associated with the 2017 Engineering clerk MOA. The data conversion of the Pennsylvania records is progress and barely moving.  The Union needs to review further for violations of that agreement.
    • Tracy Owen has sent email requesting that Union meet to address Team performance bonus and metrics. The Company is requesting to change two of the metrics.  As of April 18th, 2018, we haven’t agreed to any changes.

     

    Safety Committee

    Affiliate Report:

    AT&T Mobility:

    A nationwide investigation is going on in regards to charge backs.  No one disciplined yet.

    ATT-218-18    Darren Magar was issued an unjust counseling notice.

    ATT-219-18    The Company unjustly terminated Patti Ross’s health insurance benefits.

    ATT-220-18. Brianna Pevc hasn’t been scheduled according to her preferences and seniority.

    The Grievance was heard at first step on April 18th.

    ATT-221-18    Kelli Pilaroscia was unfairly denied Paid Family Leave and unjust disciplined in the attendance program.  Working on scheduling a first step meeting.

     

    City of Canandaigua PBA:

    Town of Greece:

    Greece Part Time Unit:

    A fact-finding hearing was scheduled for December and cancelled with the hopes of scheduling a bargaining meeting to reach agreement. The unit President is dealing with the loss of her husband and no further meetings have been scheduled at this time.

    Town of Greece Crossing Guards:

    Sharon DeLucia termination: Brief has been filed by Union attorney to State supreme court and the Union will await a hearing date for the case.

    Bargaining: The parties are at impasse and no further date has been scheduled.

    Greece Lighthouse:

    The Union has grieved that member Susan Duggan was improperly laid off.

    A meet and greet of the full timers and part timers was held on May 10th at the Ridgemont country club.  The following was addressed.

    • The Janus Supreme Court Decision impact on Public Sector employees
    • The Locals Dental plan and new network
    • Town of Greece contracts
    • Good and Welfare

    City of Canandaigua DPW:

    Nothing new to report

    Town of Canandaigua Employees Highway Association:

    Town of Henrietta:

    Grievance H00-550-17 The Union reached a settlement on behalf of the Grievants Barbara Bresnan and Jamie Dey which they signed.  They will receive adjusted out of Title pay, pay differential for the out of title hours and first preference for Out of Title hours to work towards promotion into the MMII title.

    The Town is currently in the process of creating a full-time position in engineering called Geographic Information Systems Technician.  This will be full time bargaining unit position.

    Village of Waterloo PBA:

    • A tentative agreement has been reached as of February 20th. The agreement is retroactive back to June 1st 2017 expiring May 31st, 20121. The agreement provides for the following.
    • Wages: June 1, 2017 – $.80 per hour, June 1, 2018 – $.70 per hour, June 1, 2019 – $.75 per hour, June 1, 2020 – $.80 per hour.
    • Vacation: increase of two days after 20 years.
    • Health insurance: Increase employee contributions to the following amounts.
      • 2017- 15%, 2018 – 17%, 2019 – 19%, 2020- 20%

     

    Town of Gates:

    March 1st met with the full time Librarians to discuss Union Officers, Stewards, next contract as well as Janus Supreme Court case impacting public sector Unions.

    Political Action Committee:

    March 2013 is CWA Lobby day. See Demiah Smith report

    Other:

    CWA National President Chris Shelton is proposing to dissolve the Printing sector and fold it into the existing units.  The successful impact is bargaining and arbitration would fall under district one vs the current staff of the Printing Sector.  The Printing sector is adamantly opposed to the change and is challenging the Authority of President Shelton to do so.

    ByLaw committee – Next meeting scheduled for April 26th.

    On May 2nd training for ten officers from CWA Local 1170 affiliates took place.  CWA Staff Rep Erin Bowie and Attorney Jonathan Johnsen spent the better part of the day teaching the basics.  Union Representatives from the Town of Gates, Henrietta, Greece, and City of Canandaigua participated.
