In the upcoming months Important Legislation will be introduced to your New Congressional & Senate representatives. This critical legislation is the “Employee Free Choice Act” (EFCA). The importance of this Bill is absolutely essential for the survival of our Union movement. The following is the “Real Secret” Companies don’t want you to know about Employee Free Choice Act:

What E.F.C.A. Does for Workers:

1) Gives Workers a choice between secret ballots and majority sign up. Once a majority of workers (51%) makes it clear they want a Union by Majority Card sign-up, the Union will be recognized. If the Workers want a Secret Ballot, this process can still be used as well. Employers are not allowed to hijack the process by choosing which one is used; the Workers have the choice not the employer.
2) Strengthens penalties against employers who break the law. Current labor laws are weak & many employers take advantage of the loop holes. EFCA would increase the penalties against employers who illegally fire or retaliate against those employees who are promoting an organizing campaign or are trying to get a 1st contract.
3) It allows Employees or Employers to request mediation if a 1st contract cannot be attained through negotiations. Many Employers practice “Surface Bargaining” with Bogus proposals in order to drag the process out with no real end in site. EFCA will help strengthen the Workers opportunity to get a 1st Contract bargained fairly in a reasonable amount of time.
4) Under EFCA and the National Labor Relations Board (NLRB), Workers are still free to use “Secret Ballot” elections, however with EFCA the Majority Sign-up is an additional option to ward off the threat of intimidation and worker abuse which happens during secret elections. All types of Intimidation are used to stop Unions which include threats to shut the plants, bribing workers not to join, use of favoritism towards workers on the job who are pro company and the Firing of Pro Union workers. The Employee Free Choice Act will provide protection for Workers during elections & organizing.
5) Most Importantly EFCA will allow workers the right to Organize in an atmosphere that is less hostile so that people have a “real” choice in the workplace.

The Employee Free Choice Act (EFCA) substantially reduces workers from coercion. Since 1935 Majority sign- up has been in existence, so this is not a “New” approach. The Employee Free Choice Act gives workers a fair chance to voice their choice in an election process without reprisal.
